Terms & Conditions
These terms govern your use of BookItMalta, a trading name of TrueNorthDigital ("BookItMalta", "we", "us"), to enquire about and secure a charter offered by one of our partner operators in Malta. By submitting an enquiry or paying a booking fee you agree to these terms on behalf of yourself and all guests in your party.
1. What BookItMalta does — and what it does not do
- BookItMalta provides a booking service. We introduce customers to charter operators, take a booking fee on our own account to secure your date, and pass operational details to the operator.
- BookItMalta is not the charter operator. The charter itself — the vessel, crew, fuel, food, itinerary, safety, and on-the-day experience — is supplied directly by your chosen partner operator. The contract for the charter is between you and that operator, on their terms.
- You enter into two separate transactions: a €300 booking-service fee with BookItMalta (paid now to lock your date) and a charter-price contract with the operator (paid directly to the operator on the day, at the operator's published charter price).
2. Booking process
- All enquiries are provisional until the operator issues written confirmation. Availability can change quickly during peak months.
- Once the operator confirms availability we send you a secure payment link for the €300 BookItMalta booking fee. Your date is locked the moment your payment lands.
- Payment links expire after 24 hours by default. If you pay after the link's expiry window we may, at our discretion, refund the payment if the date has been given to another customer in the meantime.
- We reserve the right to decline enquiries that conflict with operator availability, safe capacity, or maritime regulations.
3. The €300 booking fee
- The booking fee is retained by BookItMalta as payment for the booking-service we provide (matching you to an operator, securing the date, handling enquiry-and-confirmation correspondence, taking your card details via Stripe, issuing your booking-fee receipt).
- The booking fee is not a deposit on the charter price, and it does not reduce the amount you pay the operator on the day. The charter price is a separate transaction.
- BookItMalta is registered as a small undertaking under Article 11 of the Malta VAT Act (Chapter 406). No VAT is chargeable on the booking fee and no input VAT is recoverable. Your receipt will reflect this exemption explicitly.
4. The charter price
- The charter price is paid directly to the operator on the day of the charter, by whatever method the operator accepts (cash, bank transfer, the operator's own payment link).
- VAT on the charter price, if applicable, is between you and the operator. The operator issues their own receipt for the charter.
- BookItMalta does not collect, hold, or remit the charter price.
5. Cancellations and refunds
- You cancel 7 or more days before the charter date: the €300 booking fee is refunded less a payment processing fee retained by our payment provider, currently approximately 2% of the booking fee (around €5.95 on a €300 fee). This fee is not charged by BookItMalta — it is the non-refundable cost of processing the original card payment, which our payment provider retains regardless of refund. We refund to the same card you used, typically within 5–10 business days.
- You cancel within 7 days of the charter date: the €300 booking fee is forfeit. We do not refund.
- The operator cancels (weather, mechanical, force majeure): the €300 booking fee is refunded less the same payment processing fee described above (approximately €5.95). The payment processing fee is retained by our payment provider on every refund regardless of who initiated the cancellation, so this is consistent with the customer-cancellation case. The operator may offer you a re-booking on a future date at no further booking-fee charge, but you are not obliged to accept.
- You are a no-show on the day: the booking fee is forfeit and the operator may invoice you the full charter price under their own contract.
- Cancellation requests must be in writing, by email to true-northdigital@outlook.com or to the operator directly.
6. Your responsibilities
- Provide accurate guest numbers, dietary requirements, and contact details when enquiring.
- Communicate any cancellation or change of plans as early as possible.
- Follow the operator's terms and the captain's instructions on the day. The captain has ultimate authority over navigation, safety, and behaviour on board.
- Respect Maltese maritime law, including restrictions on smoking, littering, alcohol consumption, and noise.
7. Operator responsibilities
Each partner operator must hold valid vessel insurance, public liability cover, and any licences required by Maltese law to operate commercial charters. BookItMalta verifies operator credentials at onboarding and on renewal, but we do not undertake continuous monitoring of operator compliance during the charter.
8. Liability
- BookItMalta's liability is limited to the €300 booking fee. We do not accept liability for the charter itself — that is the operator's contractual responsibility.
- Nothing in these terms limits liability for death or personal injury caused by our negligence or fraud.
- We are not responsible for personal belongings lost or damaged during the charter unless caused by our direct negligence.
9. Weather and safety
The captain may alter the itinerary, delay departure, or cancel the charter if weather or sea conditions make sailing unsafe. If the operator cancels for safety, the booking fee is refunded as set out in section 5.
10. Photography and marketing
The operator may take onboard photographs for promotional use. Please notify the operator before departure if you prefer not to be photographed.
11. Data protection
We process personal data in line with our Privacy Policy. You are responsible for sharing that notice with any guests whose personal data you provide.
12. Governing law and disputes
These terms are governed by the laws of Malta. Any dispute relating to the booking fee or BookItMalta's service shall be submitted to the exclusive jurisdiction of the Maltese courts. Disputes about the charter itself are between you and the operator under their own terms.
